This Instructure Intelligent Insights Product Supplement applies to and governs Instructure’s Service identified on the Order Form as Instructure’s Intelligent Insights Service (“Intelligent Insights”).
- New and Experimental Technological Area. Customer understands and acknowledges that generative artificial intelligence (“GAI”) technology is a new and experimental technological area. Customer acknowledges that access to and use of the Intelligent Insights could be impacted by regulatory actions, legislation, or proposed legislation or policies, as well as technical changes and/or modifications, which could change, limit, or restrict, among other things, access to and use of certain features, products, or services of the Service.
- Artificial Intelligence Disclosure. Customer understands and acknowledges that Intelligent Insights relies on GAI technology, which is subject to limitations as a result of its, among other things, training data set, algorithms, structure, organization, parameters, and weights. Customer also understands and acknowledges that artificial intelligence can be prone to errors, hallucinations, and other issues affecting the accuracy of the outputted information. All output should be reviewed by a human for accuracy.
- Customer Agreements and Restrictions. Customer agrees: (1) only to allow administrative-level Users to access and use Intelligent Insights; (2) to provide notice in connection with any output or information generated by Intelligent Insights that it was generated by GAI technology; (3) to notify Instructure of any errors or issues with Intelligent Insights, including but not limited to hallucinations, mistakes, and instances of bias or discrimination; and (4) not to use output of Intelligent Insights to develop a competing artificial intelligence model.
- Ownership of Output. Customer expressly agrees to the use of its Customer Content in conjunction with GAI technology. To the extent permissible by law, all output from Intelligent Insights that is generated based on Customer Content shall be considered Customer Content. Customer acknowledges that due to the nature of Intelligent Insights and GAI generally, output that the Customer generates from Intelligent Insights may not be unique and other customers may receive similar content from use of the Service. Responses generated for other customers are not considered Customer Content.
- Customers’ Use of Intelligent Insights. Instructure and its licensors have the right to store, analyze, maintain, use as training data, and otherwise process any and all of Customer’s interactions with Intelligent Insights, including but not limited to Customer’s inputs into the chat, Customer’s feedback on Intelligent Insights, and Customer’s modifications of the SQL code generated by Intelligent Insights based on Customer’s inputs, which shall be considered Usage Data for the purposes of this Agreement.
